Terms of Service

Kulturee connects travellers with verified local hosts, editorial guides and trip planning tools. These Terms explain what we do, what you agree to, how money moves through the Kulturee wallet, and what happens when a booking is cancelled.

1. Who we are and what this covers

Kulturee is a cultural travel platform operated by Tytron & Management LLC, a company registered in Delaware, USA under number 3933193, with its registered office at 113 Gloucester Blvd, Middletown, DE 19709, USA (“Kulturee”, “we”, “us”). In these Terms, “you” means the person using the Kulturee mobile app, this website, or any service we provide.

These Terms are a binding agreement. By creating an account or using the service you accept them. If you do not accept them, do not use Kulturee.

Some parts apply only to particular people: Section 7 applies to K-hosts, and Section 6 applies to anyone booking an experience.

2. Eligibility and your account

You must be at least 18 years old to hold a Kulturee account. Kulturee is not designed for children and we do not knowingly collect their data.

You are responsible for what happens under your account, for keeping your password private, and for the accuracy of what you tell us. Tell us immediately at help@kulturee.world if you believe someone else has access to it.

One person, one account. Accounts may not be sold, shared or transferred. We may refuse, suspend or close an account that breaches these Terms, that we are required to close by law, or that presents a risk of fraud or harm to other users.

3. What Kulturee provides

Kulturee gives you a set of tools. It is not a travel agent or a tour operator.

  • Discovery and content. Editorial guides, places, collections and posts from the community.
  • Cole, our AI trip planner. Cole generates itinerary suggestions. They are suggestions: opening hours, prices, safety conditions and availability change, and Cole can be wrong. Check anything that matters before you rely on it.
  • Flights and stays. Booked through third-party travel suppliers. Their own terms, fare rules and cancellation conditions govern those bookings and are shown to you before you pay. We act as a technical intermediary.
  • K-host experiences. Small-group experiences offered by independent, verified hosts. See Sections 6 and 7.

We may change, suspend or withdraw features. Where a change materially reduces what you have already paid for, Section 6 on refunds applies.

4. The Kulturee wallet

Your wallet holds a balance in US dollars that you top up by card or another supported method through our payment provider. We show every movement in the transaction list.

  • The wallet is a prepaid balance for spending on Kulturee. It is not a bank account, it earns no interest, and it is not covered by any deposit protection scheme.
  • Refunds are returned to the wallet balance, not to your card, unless the law requires otherwise or we agree otherwise in writing.
  • Top-ups are processed by our payment provider, who may apply its own fees and currency conversion. Your bank's conversion and international transaction charges are between you and your bank.
  • You can ask us to return an unspent balance to its original source by writing to help@kulturee.world. We may need identity checks first, and we may refuse where we reasonably suspect fraud or a legal restriction applies.
  • If your wallet is untouched for 12 months we will contact you about the balance. A balance still untouched after 10 years may be handled as unclaimed funds in line with applicable law.

You may not use the wallet to transfer value to another person, to convert currency, or for anything other than paying for Kulturee services.

5. Prices and fees

The price you see is the price you pay. Kulturee does not add a service fee, booking fee or trust fee to a traveller's experience booking. The total shown before you confirm is the total taken from your wallet.

Kulturee earns its money from a commission deducted on the host's side of the transaction (Section 7). Flights, stays and other third-party bookings show their own taxes and supplier charges before payment.

Prices are in US dollars. Where a price is displayed in another currency it is an estimate for convenience only; the charge is made in US dollars.

6. Booking an experience, and cancellations

When you book, the full amount leaves your wallet immediately and your seat is reserved. You receive a ticket with a check-in code. The host is not paid at that moment: Kulturee holds the money and settles the host after the experience has taken place.

Your contract for the experience itself is with the host, not with Kulturee. We verify hosts, take payment, and hold it until completion.

If you cancel

  • More than 24 hours before the start time: full refund to your wallet.
  • Within 24 hours of the start time: no refund. The host has held the place for you and prepared for it. You can still cancel to release the seat.
  • If you do not turn up and have not cancelled, the booking is treated as used and is not refunded.

If the host cancels

  • You receive a full refund, whatever the timing, together with a notification. You do not need to ask.
  • Where an experience states a minimum number of guests and that minimum is not met, the session may be cancelled automatically before it starts and everyone is refunded in full. The minimum is shown on the listing before you book.
  • We may also credit your wallet with a goodwill amount where a host cancels at short notice. Any such credit is discretionary and has no cash value.

If we cancel

If we remove an experience or a host from the platform before a session you have booked, you receive a full refund.

Refunds reach your wallet immediately. Nothing in this section limits rights you have under consumer law that cannot be excluded by agreement.

7. K-host terms

This section applies if you host experiences on Kulturee.

Verification

Hosting requires identity verification, carried out by our verification partner. They collect and hold your identity documents; Kulturee receives the decision and a limited summary, not your document images. Verification may be declined or later withdrawn, and hosting stops if it is.

You are independent

You are an independent operator, not an employee, agent or partner of Kulturee. You decide what you host, when, at what price and for how many people. You are responsible for running it safely and lawfully: permits, licences, insurance, health and safety, the suitability of any venue or vehicle, and the conduct of anyone helping you. You are responsible for your own taxes and for any VAT or sales tax due on what you charge.

Commission and settlement

  • Kulturee deducts a commission from each completed booking: 18% standard, 15% for Pro hosts, and 10% for Founding hosts during their founding period. The rate that applies is the one in force when the booking is made, and it is fixed for that booking.
  • The traveller pays no separate fee, so you should set your price with the commission in mind. The app shows what you will receive per guest as you set it.
  • Money becomes owed to you when the booking is completed: when you check the guest in, or when the session has ended. It is not paid into a wallet. Kulturee settles owed amounts to you separately, on the schedule and by the method we tell you, once any adjustments under this section are netted off.
  • You must give us accurate payment details, and any tax information we are required to collect, before we can settle.

If you cancel

Cancelling on a guest is the most damaging thing a host can do, so it carries a cost. The traveller is always refunded in full, and:

  • More than 7 days before the start: no fee.
  • Between 24 hours and 7 days: a fee equal to the commission Kulturee would have earned on the cancelled bookings.
  • Within 24 hours, or if you do not turn up: twice that fee, and any Founding rate is forfeited.
  • An under-filled session cancelled automatically because your stated minimum was not met carries no fee.
  • We may waive a fee where you cancel for reasons genuinely outside your control, such as severe weather, illness, bereavement, or a failure on our side. Tell us at help@kulturee.world.

Fees are deducted from what we owe you. If we owe you nothing, the amount carries forward against your next settlement. Repeated cancellation, as a guide three or more in 90 days, may pause your listings until we have spoken.

Your listings

Listings go live immediately and are moderated afterwards. They must be accurate, be yours to offer, and not mislead about what is included, where it starts or who runs it. We may pause, edit or remove a listing that breaches these Terms or the law.

8. Acceptable use

You agree not to:

  • break the law, or use Kulturee for fraud, money laundering, or to get round sanctions;
  • post content that is unlawful, hateful, harassing, sexually explicit, violent, or that infringes someone else's rights;
  • impersonate anyone, or misrepresent your identity, business or qualifications;
  • take a booking off-platform to avoid commission, or solicit Kulturee users to do so;
  • scrape, crawl or bulk-extract data, probe our security, or interfere with the service;
  • upload malware, or attempt to access accounts or data that are not yours.

You can report content or a person from within the app. We review reports and may remove content, warn, suspend or close accounts.

9. Your content and ours

You keep ownership of the photos, videos, reviews, listings and other content you post. By posting it you grant Kulturee a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and distribute that content for the purpose of operating and promoting the service. The licence ends when you delete the content, except for copies already shared by others, held in backups, or kept where the law requires.

You confirm you have the rights to what you post, including permission from anyone identifiable in it.

Everything else, including the Kulturee name, logo, software, editorial content and catalogue, belongs to us or our licensors and may not be copied or reused without permission.

If you believe content on Kulturee infringes your copyright, write to help@kulturee.world with the details and where to find it.

10. Liability

Experiences are run by independent hosts, and flights and stays are supplied by third parties. Kulturee does not run them and is not responsible for them. We are responsible for operating the platform with reasonable care and skill, for holding and refunding money as these Terms describe, and for verifying hosts as described.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, lost profit, lost enjoyment or wasted expenditure, and our total liability to you for any claim is limited to the greater of the amount you paid through Kulturee in the twelve months before the claim, or [CAP].

You agree to cover our losses where a claim arises from your breach of these Terms, your content, or, if you are a host, the experiences you run.

11. Complaints, suspension and disputes

Start with us: help@kulturee.world. Most booking problems are resolved directly, and we would rather hear about it than read about it.

We may suspend or close an account, withhold a settlement, or reverse a transaction where we reasonably suspect fraud, a serious breach of these Terms, or where the law requires it. We will tell you why unless we are prevented from doing so.

You may close your account at any time from the app. Closing it does not cancel bookings already made or settlements already owed.

These Terms are governed by the laws of Delaware, USA, and the courts of Delaware, USA have exclusive jurisdiction, except where consumer law gives you the right to bring a claim where you live.

12. Changes and contact

We may update these Terms. If a change materially affects your rights we will give you reasonable notice in the app or by email before it takes effect. Continuing to use Kulturee after that means you accept the new version.
